The Holy Synod of the Ukrainian Orthodox Church -
Kyiv Patriarchate
convened on January 23, 2010
at the Patriarchal Residence,
chaired by His Holiness Patriarch of Kyiv
and all Rus-Ukraine Filaret.

HEARD:

Report of His Holiness Filaret, Patriarch of Kyiv and all Rus-Ukraine regarding the failure of the Most Reverend Alexander (Bykovetz), Archbishop of Uman (Detroit, USA) to fulfill the requirements set by the Holy Synod of the Ukrainian Orthodox Church - Kyiv Patriarchate (Journal No. 27 of December 13, 2009).

REFERENCE:

At its meeting on December 13, 2009 the Holy Synod considered the activities of Reverend Alexander (Bykovetz), Archbishop of Uman (Detroit, USA) and resolved accordingly (Journal № 27 of December 13, 2009). Among other requirements, the Holy Synod ordered the Most Reverend Alexander, Archbishop of Uman to communicate, within one month and in clear and unambiguous form, a letter addressed to the Primate refuting claims to leadership of a separate, non-existent jurisdiction entitled «UAOC (Sobornopravna)» (para. 8). The Holy Synod resolved that if the Most Reverend Alexander, Archbishop of Uman did not fulfill the decisions of the Holy Synod regarding this matter, the Holy Synod would at its next meeting reconsider his continued presence within the episcopate of the UOC – Kyiv Patriarchate (para. 9).

The Holy Synod received from the Most Reverend Alexander, Archbishop of Uman a letter dated January 11, 2010 indicated as being sent in response to the statements and resolutions set forth in Journal Number 27 of the Holy Synod held on December 13, 2009. In this letter, the Most Reverend Archbishop Alexander does not deny his claims to leadership of a separate jurisdiction known as the «UAOC (Sobornopravna)», but instead argues, despite the unambiguous facts noted in Journal Number 27 the Holy Synod held on December 13, 2009, that there exists within the Kyiv Patriarchate a separate jurisdiction under the name «UAOC (Sobornopravna)», of which he is the head.

RESOLVED:

1. To declare that the Most Reverend Alexander (Bykovetz), Archbishop of Uman (Detroit, USA) has not complied with the resolutions of the Holy Synod related to his ministry (Journal No. 27 of December 13, 2009), and has particularly failed to deny in clear and unambiguous form in a letter addressed to the Primate any claim to leadership of a separate non-existent jurisdiction under the name «UAOC (Sobornopravna)». To the contrary, the Most Reverend Archbishop Alexander repeats, in a letter addressed to the Holy Synod, his previously-stated claim to lead a separate jurisdiction within the Kyiv Patriarchate. In so doing, the Most Reverend Archbishop Alexander (Bykovetz) provides further proof that he stands in violation of canonical requirements (e.g., the 34th Apostolic Canon), the Constituion of this Church, the decisions of its Holy Synod, and the orders of its Primate, who is also his ruling bishop, and that he does not recognize the jurisdiction of the patriarch of Kyiv and All Rus-Ukraine or of the Holy Synod of the Ukrainian Orthodox Church - Kyiv Patriarchate.

2. To note that Archbishop Alexander (Bykovetz) further considers himself head of a separate jurisdiction, the UAOC (Sobornopravna), whose existence is not provided for in the Constiution of the Kyiv Patriarchate or in the resolution of the Holy Synod of the Kyiv Patriarchate of November 30, 1994 (Journal No. 17) by which the hierarchy, clergy and parishes of the former UAOC (Sobornopravna) were received into the Patriarchate. As such, Archbishop Alexander (Bykovetz) is excluded from the Ukrainian Orthodox Church - Kyiv Patriarchate.

3. To instruct the Very Reverend Victor Poliarny, Secretary of the Vicariate of the UOC - Kyiv Patriarchate in the USA and Canada, to inform the Vicariate parishes in the United States and the relevant civil authorities of the United States of America that Archbishop Alexander (Bykovetz) does not belong to the UOC - Kyiv Patriarchate. The parishes and remaining clergy formerly within the UAOC (Sobornoprovna) which were received into the Ukrainian Orthodox Church - Kyiv Patriarchate by the Holy Synod (Journal No. 17 of November 30, 1994) remain under the protection of the Kyiv Patriarchate.
